1.   Public Hearing to Consider Revisions to Article III Regarding Portable Storage Structures  
  The County has received complaints regarding the storage of portable containers (PODS, large commercial grade dumpsters) on residential properties and the length of time these structures have been allowed to remain on the property. The County's land development code does not currently address portable storage structures and has no authority to enforce the removal of them. At the request of Commissioner Cummings, as directed by the County Manager, a revision to Article III is proposed to allow Portable Storage Structures within certain zoning districts and to provide conditions for said use.
 
2.   Public Hearing to Consider Revisions to Article III  
  Staff is proposing several changes to Article III. The first two changes are being proposed to resolve compliance issues with the community association building within the Loch Rane subdivision. The first change would add Community Association Buildings and Neighborhood Activity Centers as a Permitted Use within the PS-2 (Private Service District) zoning category. The second change would add a provision that certain parcels be exempt from the side setback requirement of the PS-2 zoning district. The side setback for these parcels would be no less than five feet. Staff is also updating the provisions for Visual Barriers throughout Article III to reflect the adoption of Article VI, Tree Protection and Landscaping Standards.
 
3.   Public Hearing to Consider Revisions to Article VIII Regarding Parking and Driveway Access  
  Staff is proposing changes to Article VIII, Design and Improvement Standards to add requirements for driveway access. Driveway and drainage structure requirements were originally provided for in a separate ordinance. That ordinance (Ordinance 89-98) will be repealed and the provisions of the ordinance will be incorporated into Article VIII. Staff is also proposing changes to update the requirements for ADA parking consistent with requirements of the Florida Building Code. These changes will: 1) Increase the minimum width of accessible sidewalks and ramps from three feet to five feet, and 2) Increase the minimum width of accessible parking spaces (cars and vans) from eight feet to twelve feet.

 
4.   Discussion on merging the Clay County Historical Commission and the Clay County Historic Preservation Board into a single entity; and to cure unintended omission of Historic Preservation Provisions by readopting the portions.
 
  The Historical Commission has been acting as the Historic Preservation Board since the Board was inactive. The Commission reviewed applications for the National Register, responded to historic preservation issues, and initiated local discussions related to such. For that reason, staff is recommending to merge the Historical Commission and the Historic Preservation Board into a single entity by revising Article XII of Land Development Code, which is more stringent than Article II, Chapter 2 of the Clay County Code. Also, in 2009, Clay County restructured the Land Development Code via Ordinance 2009-52 to clarify and organize the details related to “Administration, Amendment and Enforcement Procedures.” At that time, provisions of Historic Preservation (Ord. 94-01 or Article IX of LDC) were unintentionally left out and staff recommends to cure the problem by readopting the provisions that have been omitted.
