Announcing - the opening of a recruitment to fill four positions on the Commission on Aging, three positions on the Community Services Commission, and three positions and one alternate on the Parks, Recreation and Open Space Commission, each to serve a four-year term ending June 30, 2017; advise that the incumbents to each of the positions has the opportunity to apply for reappointment; and set Friday, May 17, 2013 at 5:00 p.m. as the deadline for receipt of applications by the Administrative Services Coordinator.

  3. CITY COUNCIL CONSENT ITEMS:
    1. Approving - the minutes from the meeting of March 5, March 9, and March 12, 2013. (No Fiscal Impact) Recommended by City Clerk.
    2. Confirming - the continuation of the emergency status for Project No. 2256 (Camp Concord Bathhouse Restoration) pursuant to Section 22050 of the Public Contract Code.
    3. Accepting - improvements for Project No. 2188, Concord Blvd. Pavement Rehabilitation (Sixth Street to Bailey Road) constructed by Bay Cities Paving & Grading; and direct the City Clerk to file a Notice of Completion. (Funded by Congestion Management Agency (CMA) Block Grant of $2,147,000, a CalRecycle Rubberized Asphalt Concrete Grant of $238,500, and $590,628 from AB2928/Gas Tax and Measure J ). Recommended by Director of Community and Economic Development.
    4. Accepting - the improvements for Project No. 2189, Clayton Road/The Alameda Traffic Signal) constructed by Steiny and Company, Inc. of Vallejo; and direct the City Clerk to file a Notice of Completion (Funded by Measure J) Recommended by Director of Community and Economic Development.
    5. Awarding - a contract to GCS Environmental Equipment Services, Inc. as the lowest responsible bidder in the amount of $197,460.00, for RFB #2253, Street Sweeper. (Funded by Stormwater Fund) Recommended by Director of Community and Economic Development.
    6. Approving - a new Equipment Schedule 2 to the Master Lease Agreement No. 1592344 with US Bank, for multi-function copier equipment, provided by MRC Smart Technology Solutions, in the amount of $14,591 per year for five years; and authorize the City Manager to execute the amendment and the Finance Director to complete the lease forms. (Replacement Funds) Recommended by Director of Information Technology.
    7. Awarding - the purchase of two 2013 Ford Utility Police Interceptors in the amount of $52,647.36 to Future Ford as the lowest responsive bidder to RFB #2254 by applying the best value concept per City Municipal Code. (Funded by Vehicle Replacement Funds) Recommended by Director of Public Works.
    8. Authorizing – notification to the California State Controller of the City of Concord's election to become subject to the Uniform Public Construction Cost Accounting Procedures, under Public Contract Code Section 22030, et. seq. Resolution No. 13-21 for adoption. (No Fiscal Impact) Recommended by City Clerk.
    9. Approving - and accepting the General Plan Annual Progress Report, including the Housing Element Annual Progress Report, and directing staff to submit the report to the Governor's Office of Planning and Research and to the State Department of Housing and Community Development. (No Fiscal Impact) Recommended by the Planning Commission.
  4. CITY COUNCIL PUBLIC HEARING:
    1. Consideration - of an amendment to the Concord Municipal Code, Section 122, Development Code, Article II (Zoning Districts – Uses and Standards), Division 1 (Development and Land Use Approvals), Section 122-57 (Prohibited Uses), barring outdoor cultivation of medical marijuana, and Article IX (General Terms), Division 1(Use Classifications), Section 122-1580 (Use Classifications) modifying the descriptions of "Community Garden" and "Crop Production, Orchard, Vineyard" to exclude the cultivation of medical marijuana. Ordinance No. 13-1 for introduction. Report by City Attorney Mark Coon.


      Staff Recommendation: Hear the report; take public testimony; and Introduce Ordinance No. 13-1 by reading of the title and waiving further reading.
