    1. Approval of minutes - for the meeting held July 27, 2010. Recommended by City Clerk.
    2. Approving - the submittal of an application for full trash capture devices under the Association of Bay Area Governments Bay Area-wide Trash Capture Demonstration Project and authorizing the City Manager, or his designated representative, to execute the necessary documents. Resolution No.10-73 for adoption. Recommended by Acting City Engineer.
    3. Approving - the allocation of the City Clerk classification to Pay Grade M-7 of the Management Salary Schedule. Resolution No. 10-4735.18 for adoption. Recommended by Director of Human Resources.
    4. Approving - the acceptance of $128,964 from the Citizen's Options for Public Safety (COPS) program and allocating it for funding one and three quarters (1.75) Full Time Equivalent (FTE) civilian Crime Scene Technician position. Resolution No. 10-79 for adoption. Recommended by Chief of Police.
    5. Awarding - a construction contract in the amount of $376,521.72 to MCK Services, Inc. of Concord for Project No. 2167, Whitman Road Pavement Rehabilitation (Oak Grove Road to Detroit Avenue). Recommended by Acting City Engineer.
    6. Approving - an application for grant funds in the amount of $1,000,000 for the Urban Greening Grant Progam for the Ellis Lake Park Clear Water and Restoration Project. Resolution No. 10-81 for adoption. Recommended by Acting City Engineer.
    7. Authorizing - the filing of an application for $2,146,872 in Congestion Management Agency (CMA) Block Grant Funds for Project No. 2188, Concord Boulevard Pavement Rehabilitation (Sixth Street to Glazier Drive). Resolution No. 10-82 for adoption. Recommended by Acting City Engineer.
    8. Approving - a Professional Services Agreement with West Coast Arborists, Inc. in an amount not to exceed $110,000 to provide tree maintenance services; and authorizing the City Manager to execute the Agreement. Recommended by Acting City Engineer.
    9. Authorizing - an application for Federal Surface Transportation Program (STP) and/or Congestion Mitigation and Air Quality Improvement (CMAQ) Grant in the amount of $665,990 and committing match funds for use for Project No. 2172, Monument Corridor Shared Use Trail; and stating the assurance to complete the project.     10. Approving - the finding that a Mitigated Negative Declaration (with Mitigation Monitoring and Reporting Program) as the appropriate environmental document and; authorizing the City Manager to sign the Notice of Determination; and awarding a construction contract in the amount of $83,794.40 to Cowan & Thompson Construction, Inc. of Martinez for Project 2102, Hillcrest Park Creek Repair; waiving a minor bid defect.     11. Matter to be set for Public Hearing - on Tuesday, October 12, 2010 at 6:30 p.m. in the Council Chamber – consideration of an appeal submitted by Madan Aulakh of the Concord Police Department's denial of his application for a taxi driver permit.
    12. Approving - agreements with Future Technological Industries, Inc. for BackSafe®/SittingSafe® training and with John Muir Health for a pilot wellness program, each for a one year period; authorizing the City Manager to execute the agreements; and authorizing the use of the City's workers' compensation internal service fund to pay for the specified services rendered by the two agencies. Resolutions No. 10-83 and 10-84 for adoption. Recommended by Director of Human Resources.
    13. Accepting - the General Plan Progress Report and direct staff to submit the report to the Governor's Office of Planning and Research and to the State Department of Housing and Community Development. Recommended by Assistant City Manager.
  2. CITY COUNCIL CONSIDERATION ITEM
    1. Consideration - of the following concerning an application for Pop's Bingo World. This item was continued from the meeting held July 27, 2010 at the request of the applicant.

      1) Consideration - of a request for reconsideration of the action taken by the City Council on July 13, 2010 concerning Pop's Bingo World (AA 10-01 0) submitted by the applicant; - OR -

      2) Adoption - of a resolution confirming Council's decision on July 13, 2010 to grant an appeal and deny without prejudice the Administrative Application for Pop's Bingo World (AA 10-010). Resolution No. 10-71 for adoption. Report by Frank Abejo, Senior Planner.

      Staff Recommendation: Hear report, take public testimony, adopt Resolution No. 10-71, granting an appeal and denying without prejudice the Administrative Application for Pop's Bingo World.
    2. Consideration - of the appointment of up to six applicants to the Commission on Aging for terms ending June 30, 2013. Report from the Council Committee on Neighborhood and Community Services.

      Staff Recommendation: Appoint up to six applicants to terms ending June 30, 2013.
    3. Consideration - of the appointment of four applicants to the Concord Community Services Commission for terms ending June 30, 2013. Report from Council Committee on Neighborhood and Community Services.

      Staff Recommendation: Appoint four applicants for terms ending June 30, 2013.
    4. Consideration - of the appointment of three applicants to the Concord Parks, Recreation and Open Space Commission for a term ending June 30, 2013, and one applicant to serve as an alternate for a one-term ending June 30, 2011. Report from Council Committee on Recreation and Cultural Affairs.

      Staff Recommendation: Appoint three applicants for a term ending June 30, 2013 and one applicant, as alternate, for a term ending June 30, 2011.

CITY COUNCIL PUBLIC HEARINGS

  1. JOINT CITY COUNCIL/REDEVELOPMENT AGENCY CONSENT ITEMS
    1. Consideration - of an amendment to Concord Municipal Code, repealing Section 110-42, "Screening, pretreatment, and measurement of industrial waste; prohibited and restricted discharges" in its entirety and replacing it with a new Section 110-42, "Screening, pretreatment, and measurement of industrial waste; prohibited and restricted discharges," correcting discrepancies between the Code and current practices, and between Code and Contra Costa Central Sanitary District (CCCSD) ordinances used for pretreatment inspections. Ordinance No 10-5 for introduction. Report by Jeff Roubal, Senior Administrative Analyst.

      Staff Recommendation: Hear the report, take public testimony, introduce Ordinance No. 10-5 by reading of the title only and waiving further reading.
    2. Consideration - of an appeal submitted by Wieslaw J. Pisula over the Concord Police Department's denial of an application for a Taxi Driver Permit. Report by Lt. Darrell Graham.

      Staff Recommendation: Hear the report, take public testimony, and deny the appeal submitted by Mr. Pisula of the Police Department's denial of his application to operate a taxi cab in the City of Concord.
    3. Consideration - of an amendment of the City's contract with the Board of Administration of the California Public Employees Retirement System to add Section 20475, creating a new tier in the retirement program for Miscellaneous New Hire Employees Only with a 2% @ 55 formula and introduction of Ordinance 10-4 (Uncodified) authorizing the amendment. Report by Kathy Ito, Director of Human Resources.

      Staff Recommendation. This item has been continued to September 28, 2010 at the request of staff.
